By-Law #2015-36, Being a By-Law to prohibit smoking at any township facility and to repeal By-law #2012-15

This Bylaw prohibits smoking (including all e-smoking devices and waterpipes) on all property owned or leased by the Township, including recreation facilities, parks/playgrounds, sports fields, offices, fire hall properties, and public works yards.

Definitions

“Smoke or Smoking” includes the carrying of a lighted or heated cigar, cigarette, pipe, waterpipe or any other equipment used to inhale, exhale, burn or heat any Smoking Product.

“Smoking Product” means tobacco or tobacco-like product whose primary purpose is to be burned or heated to produce vapours, gases or smoke, which are inhaled, and shall include but is not limited to non-tobacco herbal shisha, and other plant material or oils intended for inhalation.

“Sports Field” means any field and/or land of natural and/or man-made composition that is used for athletic purposes to conduct organized or unorganized sporting activities, which includes but is not limited to a baseball field, soccer pitch, volleyball court, player or spectator bench, ice rink, and lawn bowling field.

“Waterpipe” means a device in which the vapours, gases or smoke of a Smoking Product passes through liquid prior to being inhaled, and shall include but is not limited to a bong or hookah.

Policy Analysis

This bylaw is leading edge as it prohibits smoking, vaping and the use of waterpipes on all Township property, including in its offices.

However, the bylaw does not cover vaping or waterpipe use in other workplaces or public places.
