The Cannabis Harm Prevention Act (Various Acts Amended)

Bill 25, which received Royal Assent on 2nd June 2017 but is yet to be proclaimed, amends, among other Acts:

The Highway Traffic Act to prohibit the consumption of cannabis in motorized vehicles on a highway;

  • No person shall inhale, ingest or otherwise consume cannabis in or on a motor vehicle, farm tractor, implement of husbandry or special mobile machine on a highway.

The Non-Smokers Health Protection Act to prohibit people from smoking cannabis in enclosed public places, including through the use of e-cigarettes;

  • The definition of smoking is being expanded to include cannabis; and
  • There is a conditional amendment (because The Non-Smokers Health Protection and Vapour Products Act has not yet been proclaimed) to replace the definition “e-substance” with the following: “e-substance” means a solid, liquid or gas that, on being heated, produces a vapour for use in an e-cigarette.

The Off-Road Vehicles Act to create similar transportation and consumption prohibitions for off-road vehicles as those added for vehicles under The Highway Traffic Act;

  • No person shall inhale, ingest or otherwise consume cannabis in or on an off-road vehicle, whether or not the vehicle is in motion.

Policy Analysis

This bill is considered leading edge because the definition of smoking is amended to include the smoking and vaping of cannabis.

However, note that smoking is not outright prohibited on patios in Manitoba. This bill does not change that: the smoking of tobacco and the smoking or vaping of cannabis will still be permitted on uncovered patios in Manitoba when this bill comes into force.
