Includes both smoking and tobacco use, including smokeless/spit tobacco or any other form of tobacco that may be used for “smoking, chewing, inhalation or any other means of ingestion.” All tobacco use prohibited within 25 m of playground structures, sport playing fields, park facilities, tennis courts, outdoor rinks, youth park, skate parks, and within 9 m of recreation facilities owned, operated or leased by the County. Air intakes and operable windows are not mentioned in the bylaw.

Definitions

“Smoke or smoking” means the smoking of tobacco or similar products and includes the carrying of a lighted cigar, cigarette, pipe or any other lighted smoking equipment. “Tobacco products” refers to the use of tobacco in any form, including cigarette, cigar, pipe tobacco, smokeless/spit tobacco, or any other form of tobacco that may be used for “smoking, chewing, inhalation or any other means of ingestion.

Policy Analysis

This is considered leading edge because it addresses the use of all tobacco products, not just those that are smoked. However, only section 115 of the Municipal Act, 2001, is cited in the bylaw’s preamble, and section 115 is specific to lit tobacco.
