Bylaw No. 012-03, A By-Law of The Corporation of the Town of Innisfil to regulate Smoking in all Municipal Facilities and Public Places in the Town of Innisfil

Smoking is prohibited within 9 m of the entrance or exits of all municipal facilities. (There is no mention of air intakes or operable windows.) A two-inch wide yellow line is painted 9 m from all entrances and exits of all municipal facilities to mark the designated limits.

“Smoke” or “smoking” includes the carrying of a lighted cigar, cigarette, pipe or any other lighted smoking equipment, but does not include smoke or smoking where smoke or smoking is used in a stage production of a theatrical performance.

Policy Analysis

This bylaw allows for an exemption for smoking during stage productions, which is not recommended. Innisfil’s By-Law No. 111-13 prohibits the use e-cigarettes in certain outdoor spaces, but it has not yet been prohibited indoors. To reconcile this gap, Bylaw No. 012-03 should be amended to include e-cigarettes.


Having a two-inch wide yellow line is painted 9 m from the entrances and exits of municipal facilities to mark the area in which smoking is prohibited is one way to assist enforcement and empower members of the public to ask others not to smoke. This is an excellent tool to make the bylaw virtually self-enforcing.
