Bylaw No. 2009-040, Smoke Free Public Places and Workplaces Bylaw, Amended by Bylaw No. 2011-038

Smoking prohibited within 7.5 m (25 ft) of any exit or entrance to any municipal owned or operated facility within the Town whether or not a no-smoking sign is posted. In 2009, the distance was 5 m, but this was amended in 2011. The list of municipally owned and operated properties was also updated in 2011. There is no mention of air intakes or operable windows in the bylaw – doorways only.

Definitions

“SMOKE” OR “SMOKING” includes the carrying of a lighted cigar, cigarette, pipe, or any other lighted smoking equipment, but does not include smoke or smoking where smoke or smoking is used in a stage production or a theatrical performance.

Policy Analysis

Smoking should be prohibited during a stage production or a theatrical performance. The bylaw could be strengthened by adding air intakes and operable windows, instead of just prohibiting smoking near doorways.
