Bylaw No. 2010-45, Smoke Free By-law

Smoking prohibited within 9 m from any entrance, exit, building opening of any Town facility including but not limited to parkland, playground, sports field, spectator seating area, ice surface whether or not a “No Smoking” sign is posted; on any walkway or pathway set out on or through Town-owned property (but does not include sidewalks); anywhere on Park Drive. However, designated smoking areas are allowed.

Definitions

“Smoke” or “Smoking” includes the carrying of a lighted cigar, cigarette, pipe or any other lighted smoking equipment or product.

Policy Analysis

It is not clear whether “any walkway or pathway set out on or through Town owned and occupied property” would include nature trails, but it could be interpreted as such. Designated smoking areas, which are allowed in this bylaw, are not recommended.
