Bylaw No. 2012-003, Being a Bylaw to Regulate Smoking in the Town of Cobalt: Smoking on Municipal Property; and Smoking in Workplace Entrances and Exits; and the Sale of Tobacco Products through Licencing Requirements Also known as Bylaw No. 2012-003, Smoke-free and Tobacco Control Bylaw

Smoking is prohibited on all municipal property (including parks, beaches, playgrounds and recreational fields) unless a “Designated Smoking Area” is granted by the municipality for special events. Smoking is therefore only permitted if the municipality has designated a temporary smoking area on its Municipal property. If a “Designated Smoking Area” is granted, the area must be at least 5 m away from any entrances or exits. A proprietor of a workplace may choose to have the workplace added to the by-law. If a workplace is added to the by-law, smoking is prohibited within a 9 m radius of those entrances and exits.

Definitions

“Smoke” or “smoking” includes carrying a lighted cigar, cigarette, pipe or any other lighted smoking equipment or holding any lighted tobacco or any other substances intended to be smoked or inhaled by the person holding it

Policy Analysis

This is leading edge because smoking is prohibited on all municipal property, including beaches. Businesses are allowed to opt in to prohibit smoking on their property and the Town will enforce it. Designated smoking areas are not recommended.
