By-law No. 2009-10, Being a By-law to Establish NO SMOKING ZONES in Areas Adjacent to Public Buildings in the Municipality of Central Manitoulin

This bylaw designates No-Smoking Areas within the Municipality:

  • All Municipal Buildings are deemed to be “Prescribed Areas” as per the Smoke Free Ontario Act; and
  • The areas within a 9 metre radius of all public entrances to the aforementioned buildings are designated as “Prescribed Areas” as per the Smoke Free Ontario Act.

On 23 February 2017, Council directed municipal staff to contact the Ontario Provincial Police to request that they enforce the No Smoking Legislation at the two Municipal arenas.

Definitions

“Prescribed Area ” shall mean but not be limited to; Any building or structure owned or operated by the Municipality of Central Manitoulin and areas adjacent to a public entrance at any of the aforementioned locations.

“No Smoking Area” shall mean; An area where no person shall smoke or hold lighted tobacco products.

This bylaw exceeds the SFOA because it creates 9 m buffer zones around doorways to municipal buildings. Note that operable windows and air intakes are not included.

Enforcement
