Bylaw 2016-1975 – A Bylaw of the City of Estevan to provide for the controlling, regulating, and governing of smoking within City facilities in the City of Estevan

Estevan’s new bylaw prohibits smoking, electronic cigarettes, chewing tobacco and vaping inside recreation facilities and city-owned buildings. It also prohibits the use of these products within five metres of the entrances to those buildings, and within five metres of the playing surface of outdoor recreation facilities.

“Tobacco” includes pipe tobacco, chewing tobacco, water-pipe tobacco, cigarettes, cigars, cigarillo’s (sic) or any other similar product made with or containing tobacco

“Electronic cigarette” means a handheld device containing a liquid that is vapourized and inhaled, and includes but is not limited to electronic cigarettes, e-cigarettes, vapourizer cigarettes, personal vapourizers and electronic nicotine delivery systems
“Vape or vaping” includes the utilization of an electronic cigarette or any other heated smoking equipment used to vaporize any tobacco or non-tobacco substance whether or not it contains nicotine

“Public Place” means all or any part of a building or other enclosed space that is open to the public or to which the public is customarily admitted or invited and includes all municipal buildings within and outside the City of Estevan, or owned by the City of Estevan

Policy Analysis

This is a leading edge bylaw because it prohibits vaping in and within 5 m of any building to which the public has access. Vaping is also prohibited at and within 5 m of playgrounds and sports and recreational fields. The use of chewing tobacco is also prohibited in these same public places, as well as inside buildings to which the public has access.
