Highway Traffic Act

Smoking or e-cigarette use is prohibited in a motor vehicle while another person who is younger than 16 years of age is in the vehicle.

Smoking or e-cigarette use in a motor vehicle by children younger than 16 is also prohibited. This applies even if the person is alone in the vehicle and regardless of the age of any other person in the vehicle. Prohibitions apply whether the motor vehicle is enclosed or not.
