Smoking Bylaw

No person shall carry or possess a lit cigarette, cigar or pipe, or burn tobacco in any manner, or use an electronic smoking device:

  • In a public premise, workplace or a public vehicle;
  • In, on or within 5 m of a playground;
  • In, on or within 5 m of an entrance or exit to a public premise; and
  • In, on or within 5 m of any place the public has access as of right or by express or implied invitation.

“Electronic smoking device” means an electronic device that can be used to deliver nicotine or other substances to the person ihaling from the device, including but not limited to an elecronic cigarette, cigar, cigarillo or pipe;

“Playground” means an outdoor area upon which apparatus such as swings and slides are placed;

“Public premises” means any place to which the public may have either express or implied access for the purpose of worship, entertainment, recreation, business, amusement, education, transportation, consumption of food or drink, or for the provision and receipt of services;

“Smoke” or “Smoking” means to inhale, exhale, burn, or have control over a lighted cigarette, cigar, pipe, hookah pipe, or other lighted smoking implement designed to burn or heat tobacco or any weed or substance for the purpose of inhaling or tasting of its smoke or emissions;

Policy Analysis

This bylaw is considered leading edge owing to its broad definition of smoking and its scope: smoking and vaping are prohibited in and around many public places indoors and out.

However, it is not recommended that vaping be included in the definition of smoking, as these are two different activities with different levels of harm and associated risk of exposure for bystanders.
