As this bylaw builds on the Alberta Tobacco and Smoking Reduction Act and its Regulation, the bylaw should be reviewed in conjunction with these documents. This record only indicates how the bylaw exceeds provincial legislation.
Nanton’s bylaw prohibits smoking and vaping on all Town property and in and within 5 m of parks, playgrounds and sports and recreation fields. Smoking and vaping are also prohibited inside all workplaces and public places. However, the bylaw allows the manager of the Town or of a private business to designate a smoking area for employees as long as it is over 5 m from the building and has, at a minimum, floor-to-ceiling walls, a ceiling and doors that separate it physically from any adjacent areas in which smoking is prohibited under the Tobacco and Smoking Reduction Act.

Electronic Smoking Device means a handheld device containing a liquid or smoking product that is vapourized and inhaled, and includes but is not limited to electronic cigarettes, e-cigarettes, vaporizer cigarettes, personal vapourizers, and electronic nicotine delivery systems.
Outdoor place or area includes any park or green space, playground or sports field or recreational area to which members of the public have access as of right or implied invitation, including any directly adjacent to or contained within, the place or area, highway within the meaning of the Traffic Safety Act.
Public place means all or any part of a building, structure or other enclosed area to which members of the public have access as of right or by express or implied invitation, including all other places as defined under the Tobacco and Smoking Reduction Act.
Smoke or smoking means to smoke, hold or otherwise have control over a lit smoking product.
Smoking product means a product intended to be smoked including but not limited to a cigarette or cigar, electronic cigarette, or any product of a legal or illicit nature intended to be smoked.
Workplace means all or any part of a building, structure or other enclosed area in which employees perform the duties of their employment, whether or not members of the public have access to the building, structure or area as a right or by express or implied invitation, and includes reception areas, corridors, lobbies, stairwells, elevators, escalators, eating areas, washrooms, lounges, storage areas, laundry rooms, enclosed parking garages and work vehicles.

This bylaw is leading edge as it prohibits the use of electronic cigarettes wherever smoking is prohibited, both indoors and outdoors.
It is also leading edge as it prohibits the use of other substances that may be used in electronic cigarettes.
The use of designated smoking areas is not recommended, particularly those that are enclosed.
