Smoking Control Bylaw Amendment Bylaw No. 7583, 2014 (to amend Smoking Control Bylaw No. 6263, 1995)

An amending bylaw to Smoking Control Bylaw No. 6263, 1995 was passed by City Council on 7 April 2014. The amendments prohibit smoking “on the outdoor patio area of any restaurant, public house or other place of business serving refreshments or food to the public.” Smoking will also be prohibited “within 7.5 metres of any opening into a building, including any door or window that opens and any air intake.” The amendments also prohibit smoking “within 15 metres of an outdoor sports field, skate park, playground, lacrosse box, lawn bowling green, stadium, picnic area, water park, wading pool, swimming pool or off-leash dog area within a City Park.”

Definitions

“Smoke or smoking” includes inhaling, exhaling, burning or carrying of a lighted cigar, cigarette, pipe or other lighted smoking equipment of tobacco or any other weed or plant.

Policy Analysis

This is a leading edge bylaw because it addresses the use of other weeds and substances, and prohibits smoking within 7.5 m of doorways, operable windows and air intakes of all buildings to which the public has access. However, the bylaw only prohibits smoking within 15 m of playgrounds and recreational fields, rather than throughout the parks in which they are located.
