District of Ucluelet Smoking Control Bylaw No. 1187, 2016, A Bylaw to Regulate Smoking

Smoking and vaping are prohibited in all municipal parks, as well as within 8 m of any doorway, operable window or air intake of a building to which the public has access. Smoking is also prohibited within 8 m of customer service areas, including patios. Designated smoking areas may be assigned for special events.

“Smoke” or “Smoking” means to purposely inhale or exhale smoke from or burn or carry, a lighted cigarette, cigar, pipe, e-cigarette or other smoking equipment that burns or vaporizes tobacco, weed or other substance


“E-cigarette” means a product or device, whether or not it resembles a cigarette, containing an electronic or battery-powered heating element capable of vaporizing a substance for inhalation or release into the air


“Customer service area” means a partially enclosed or unenclosed area, including a balcony, patio, yard or sidewalk, that is part of or connected to or associated with a business or use in a building or premises that includes the service of food or alcoholic drinks to customers or other persons for consumption on site


“Municipal Park” means any property owned and dedicated as a park by the District of Ucluelet and including but not limited to public playgrounds, playing fields, beaches, designated public spaces or public trails

Playgrounds, which may include Splash Pads and Wading Pools
Sports and Recreational Fields and Facilities

Policy Analysis

The bylaw broadly defines smoking to include vaping, which makes this leading edge. It is also leading edge because it prohibits smoking on beaches and trails, on and within 8 m of patios and within 8 m of entrance ways, operable windows and air intakes. The bylaw also prohibits smoking and vaping inside restaurants and bars, which shows how great a leap Ucluelet has made in passing this bylaw. However, it could be still strengthened by prohibiting the use of e-cigarettes inside all workplaces and public places.
